The rate increase is <br />necessary for ACI to meet current operating expenses and its bank covenants. To mitigate future <br />rate increase requests due to unforeseen economic impacts, ACI and City staff will negotiate an <br />alternative rate adjustment process that will include industry operating cost factors and a revenue <br />sharing mechanism for fluctuations in commodity prices for the sale of recyclables. The new <br />rate adjustment process will be brought before the City Council before August 1, 2009 for <br />approval as an amendment to the Agreement. <br />
