Hollister, City Manager <br />APPROVED AND <br />FORWARDED <br />TO CITY COUNCIL <br />Luke Sims, Community Development Directo,~ <br />Cynthia Battenberg~isiness DevelopmentManager <br />Elmer Penaranda, Seriior Development Specialist G~~V <br />SUBJECT PROJECT/PROJECT DESCRIPTION: <br />MATTER OF CONSIDERATION OF AN ORDINANCE RE-ESTABLISHING THE WEST <br />SAN LEANDRO SHUTTLE BUSINESS IMPROVEMENT DISTRICT <br />SUMMARY AND RECOMMENDATION <br />On March 16, 2009 the City Council held a public hearing, took testimony on re-establishing the <br />Business Improvement District (BID), and at the conclusion of the public hearing tallied the <br />protest votes received. The City received protest ballots totaling nine percent (9%), which is less <br />than 50% of the affected business owners, thus providing the City Council discretion to approve <br />the Ordinance and establish the BID. The City Council voted 4-1 in favor which Passed to Print <br />Ordinance No. 2009-002 to re-establish the BID. The Ordinance goes to the Council again on <br />April 6, 2009, the next regularly scheduled meeting, for adoption. <br />Adoption of the Ordinance would amend Title 2 of the San Leandro Municipal Code to Delete <br />Chapter 15 and add a New Chapter 15 Establishing the West San Leandro Shuttle Business <br />Improvement District in the City of San Leandro (providing the continuation of a funding source <br />for the LINKS Shuttle service until June 30, 2014). <br />Staff recommends that City Council adopt Ordinance No. 2009-002 re-establishing the West San <br />Leandro Shuttle Business Improvement District (BID). <br />BACKGROUND <br />Analysis: Not applicable. <br />Current City Council Policy: Not applicable. <br />Previous City CounciURedevelopment Agency Action(s): <br />~ Resolution No. 2009-014 was adopted by the Council on February 2, 2009 approving a <br />Resolution of Intention to re-establish the West San Leandro Shuttle Business Improvement <br />District. <br />• Ordinance No. 2009-002 was Passed to Print by the City Council (4 ayes-1 noe) on March <br />16, 2009, Amending Title 2, Chapter 15 of the San Leandro Municipal Code Relating to the <br />West San Leandro Shuttle Business Improvement District. <br />~~: ,~'''~''i''r/~~~~- <br />Stephen L.
