1N THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION N0.2009-047 (2945/3151) <br />RESOLUTION AUTHORIZING THE CITY MANAGER TO SIGN AND FILE A <br />FINANCIAL ASSISTANCE APPLICATION WITH THE STATE WATER RESOURCES <br />CONTROL BOARD FOR DESIGN AND CONSTRUCTION OF THE FOLLOWING <br />PROJECTS: WATER POLLUTION CONTROL PLANT REHABILITATION; WATER <br />POLLUTION CONTROL PLANT CO-GENERATION; WICKS BOULEVARD PUMP <br />STATION REHABILITATION; BLUE DOLPHIN PUMP STATION REHABILITATION; <br />AND SANITARY SEWER LINE REPLACEMENT -VARIOUS LOCATIONS <br />WHEREAS, the CITY OF SAN LEANDRO ("APPLICANT") is authorized to execute <br />and file an application for funding under the American Recovery and Reinvestment Act of 2009 <br />for the design and construction of the Water Pollution Control Plant Rehabilitation, Water <br />Pollution Control Plant Co-generation, Wicks Boulevard Pump Station Rehabilitation, Blue <br />Dolphin Pump Station Rehabilitation and Sanitary Sewer Line Replacement -Various Locations <br />("PROJECT"); and <br />WHEREAS, there is no legal impediment to APPLICANT making applications for the <br />funds; and be it further <br />WHEREAS, there is no pending or threatened litigation that might in any way adversely <br />affect the proposed PROJECT, or the ability of APPLICANT to deliver such PROJECT; and be <br />it further <br />WHEREAS, APPLICANT authorizes its City Manager or designee to execute and file an <br />application with the State Water Resources Control Board for American Recovery and <br />Reinvestment Act of 2009 (ARRA) funding for the PROJECT as referenced in this resolution. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San <br />Leandro that the City Manager is hereby authorized and directed to sign and file, for and on <br />behalf of the City of San Leandro, a Financial Assistance Application for a grant from the State <br />Water Resources Control Board in the estimated amount of $43,200,000, for the design and <br />construction of the Water Pollution Control Plant Rehabilitation, Water Pollution Plant Co- <br />generation, Wicks Boulevard Pump Station, Blue Dolphin Pump Station and Sanitary Sewer <br />Line Replacement -Various Locations projects, and <br />BE IT FURTHER RESOLVED that the City of San Leandro hereby agrees and further <br />does authorize the aforementioned representative or his/her designee to certify that the City has <br />and will comply with all applicable state and federal statutory and regulatory requirements <br />related to any federal and state grants received, and <br />
