Geritz, Geritz Realty, Inc., 1761 East 14`~ Street, dated August 18, 1999. -- Michael Jacobowitz, Attorney, 114 Parrott Street, Forwarding Letter with Signatures of 77 Downtown Businesses, dated August 13, 1999. -- Michael Jacobowitz, Attorney, 114 Parrott Street, Forwarding Letter with Updated List with Additional Signatures of 95 Downtown Businesses, As of August 31, 1999. -- Wendell Smith, Wendell Smith Insurance Agency, 400 Estudillo Avenue, dated August 25, 1999. Luke Sims, Economic Development Manager, gave the staff presentation regarding the proposed Business Improvement District (BID) and the request to set the Public Hearing for October 4, 1999. After a brief City Council discussion regarding the proposed amendment to the Resolution of Intention, the City Council supported the request to include the language proposed by Tom Guarino, Larry Allphin, and Michael Jacobowitz, as follows: Insert as Recitals 9 and 10 (and renumber the remaining recitals): "9. Notwithstanding any other provision in the District Resolution, businesses not paying the annual fee will not incur a liability for the benefit fee and will not be included in the District nor any District-sponsored commercial marketing programs. 10. If the District is formed, the District shall conduct a neutral ballot of all businesses in the benefit district no later than March 31, 2001, to determine whether or not the District shall continue. The results of that ballot shall be presented to the City Council for any further appropriate action."
