Geritz, Geritz Realty, Inc., 1761 East 14`~ Street, dated August 18, <br />1999. <br />-- Michael Jacobowitz, Attorney, 114 Parrott Street, Forwarding Letter with <br />Signatures of 77 Downtown Businesses, dated August 13, 1999. <br />-- Michael Jacobowitz, Attorney, 114 Parrott Street, Forwarding Letter with <br />Updated List with Additional Signatures of 95 Downtown Businesses, As <br />of August 31, 1999. <br />-- Wendell Smith, Wendell Smith Insurance Agency, 400 Estudillo Avenue, <br />dated August 25, 1999. <br />Luke Sims, Economic Development Manager, gave the staff presentation <br />regarding the proposed Business Improvement District (BID) and the request to <br />set the Public Hearing for October 4, 1999. <br />After a brief City Council discussion regarding the proposed amendment to the <br />Resolution of Intention, the City Council supported the request to include the <br />language proposed by Tom Guarino, Larry Allphin, and Michael Jacobowitz, as <br />follows: <br />Insert as Recitals 9 and 10 (and renumber the remaining recitals): <br />"9. Notwithstanding any other provision in the District Resolution, businesses <br />not paying the annual fee will not incur a liability for the benefit fee and will <br />not be included in the District nor any District-sponsored commercial <br />marketing programs. <br />10. If the District is formed, the District shall conduct a neutral ballot of all <br />businesses in the benefit district no later than March 31, 2001, to determine <br />whether or not the District shall continue. The results of that ballot shall be <br />presented to the City Council for any further appropriate action." <br />
