IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION N0.2009-062 (3110) RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LEANDRO APPROVING A COOPERATION AGREEMENT BETWEEN THE CITY OF SAN LEANDRO AND THE REDEVELOPMENT AGENCY OF THE CITY OF SAN LEANDRO FOR THE PURPOSE OF UNDERTAKING REDEVELOPMENT ACTIVITIES WTHIN THE WEST SAN LEANDRO - MACARTHURBOULEVARD REDEVELOPMENT PROJECT AREA FOR THE EDEN ROAD DEVELOPMENT PROJECT, PROJECT NO. 964-82-061 AT A COST NOT TO EXCEED $805,000 TO THE REDEVELOPMENT AGENCY WHEREAS, pursuant to Health and Safety Code Sections 33220(A), the City may aid and cooperate with the Agency in the planning, undertaking or operation of redevelopment projects and activities within the West San Leandro -MacArthur Boulevard Redevelopment Project Area ("Project Area") or outside of the Project Area if said projects/activities serve to further redevelopment goals and will be of ultimate benefit to the Project Area; and WHEREAS, California Redevelopment Law at Health and Safety Code Section 33445 provides that a redevelopment agency may, with the consent of the legislative body, pay all or a portion of the cost to acquire the property needed for the construction of any building, facility, structure, or other improvements that is publicly owned either within or without the project area if it determines all of the following: a. The buildings, facilities, structures or other improvements are of benefit to the project area or the immediate neighborhood in which the project is located; and b. That no other reasonable means of financing the buildings, facilities, structures or other improvements are available to the community; and c. That the payment of funds for the cost of buildings, facilities, structures or other improvements will assist in the elimination of one or more blighting conditions inside the project area; and d. That the project is consistent with the Five Year Implementation Plan adopted by the Agency pursuant to Section 33490; and WHEREAS, the Redevelopment Agency ("Agency") has approved a "Cooperation Agreement" attached as Exhibit "A" and incorporated herein between the Agency and the City, the purpose of said Agreement being to allow the City and the Agency to work together on the design and construction of the Eden Road Development project, of which the acquisition of 2512 Davis Street, APN: 077A-0649-008-24, is an integral element, (the "Project"); and
