AGREEMENT REGARDING THE INSTALLATION AND MAINTENANCE OF AN IRRIGATION WELL AT CHERRY GROVE PARK This Agreement for installation and maintenance of an irrigation well at Cherry Grove Park the "Agreement'), is entered into by and between the City of San Leandro, a municipal corporation of the State of California (the "City', and the San Leandro Unified School Distract, a public school district of the State of California (the "District") on this day of ~~%~r F'~ "~C~` ,2666-: City and Distract are hereinafter collectively referred to as (the "Parties"). RECITALS WHEREAS, it is the policy of the City and District to jointly undertake the development, installation, construction and maintenance of joint facilities in order to reduce capital and operational costs to both governmental jurisdictions; and WHEREAS, the Parties desire to jointly undertake the installation and maintenance of a new irrigation well to replace the old irrigation well which currently exists at Cherry Grove Park next to John Muir Middle School, located on Leonard Drive, San Leandro, California (the "Site', and incorporated herein by this reference; and WHEREAS, water from the well shall primarily be used for Cherry Grove Park, John Muir Middle School, and Woodrow Wilson School. Irrigation of John Muir Soccer Field is subject to well capacity and provided that such use does not adversely affect the primary water use. NOW THEREFORE, inconsideration of the mutual covenants of the Parties and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the Parties hereby agree as follows: 1.Construction of Irrigation Well. (a). City shall be responsible for managing the design and construction of a new irrigation well on the Site, which shall be capable of providing approximately 150 GPM at 70 psi in continuous operation. (b). The work involved in the construction of the new irrigation well is as shown on the plans and as described in the specifications entitled "Cherry Grove Park Well Replacement", Project No. 05-210-62-007 approved by the City Engineer on June 8, 2005. (c). District hereby agrees to grant City and its contractors reasonable access to District property for the purpose of construction, use and maintenance of the irrigation well during the term of the Agreement.
