Minutes - City of San Leandro City Council Meeting Page - 7 - <br />January 12, 1998 <br />Jeffrey Wise, 2079 Charlotte Avenue, addressed the Council regarding <br />concerns with the proposed parking lot adjacent to the Wal-Mart <br />property. He feels the proposed parking lot is a violation of the MOU. <br />Natalie Hordon, Representing Sportsmart, 1933 Davis Street, addressed <br />the Council in support of Wal-Mart coming to the Westgate Center. <br />Florence Ruha, 3745 Anza Way, addressed the Council in support of Wal- <br />Mart. <br />John Nunes, 28870 Mission Boulevard, Hayward, addressed the Council in <br />opposition to Wal-Mart. He stated the Council should have a Public <br />Hearing at a later date regarding the substantive issues raised. <br />Chris Harper, 3851 Monterey Boulevard, addressed the Council in support <br />of Wal-Mart. <br />Bob Videll, 15125 Wiley Street, addressed the Council in support of Wal- <br />Mart. <br />Richard Benson, 28870 Mission Boulevard, Hayward, President of Local <br />Union 870, addressed the Council and urged them to support and grant <br />their Appeal. He stated their support for the Chamber's recommended <br />Conditions for the project but stressed that the substantive issues <br />should be considered through Public Hearings so that the community can <br />express their concerns. <br />There being no further comments from the public, the Public Hearing was <br />closed. <br />M/S/C Loeffler and Glaze. Ayes: 7; Noes: 0 <br />The Council recessed at 11:30 p.m. to 11:35 p.m. <br />The Appellant, Daniel Cardozo, was provided 10 minutes for a rebuttal, <br />in which he commented on the MOU and the Conditions of Approval in the <br />Planned Development and noted that, if there were any conflicts, the <br />Planned Development governs. He added that, if there have been <br />substantial modifications, there should be additional public hearings <br />held. He further commented that policy decisions are made by <br />policymakers. They are only asking that the Council follow the normal <br />process and give the people a chance to express their concerns by <br />providing for additional public hearings before granting approvals for <br />the project tonight. <br />The Applicant's legal counsel, Judy Davidoff, followed with 10 minutes <br />of rebuttal, in which she commented there is no a basis to reopen the <br />past decisions which have been made with regard to this project. She <br />feels this project should be reviewed under the current standards and <br />further stated that there are no parking problems on this site. She <br />stated the MOU is clear, and the changes that are being requested <br />
