Yo the Plan Administrator with respect to such investments. The Trustee will <br />maintain a record of the aggregate balance (principal and earnings) for all Agency <br />Accounts. The Trust Administrator will in the ordinary course of business <br />maintain a record of the name, address, taxpayer identification number, account <br />number and amount of funds, including earnings, of each Employer. On periodic <br />valuation dates (no less frequently than monthly) to be established by the Trust <br />Administrator, the Trustee and Trust Administrator will reconcile the aggregate <br />balance information maintained by the Trustee with the Agency Account level <br />records maintained by the Trust Administrator pursuant to this Trust Agreement. <br />1.13 "OPEB"~ shall mean "other post-employment benefits," such as medical, dental, <br />vision, life insurance, long-term care and other similar benefits provided to <br />retirees, other than pension benefits. <br />1.14 "OPEB Obligation" shall mean an Employer's obligation to provide post- <br />employment health care and welfare benefits to its Eligible Employees as <br />specified in such Employer's policies and/or applicable collective bargaining <br />agreements. <br />1.15 "Plan" shall mean the Public Agencies Post-Retirement Health Care Plan, <br />adopted by each Employer as a separate Plan for that Employer upon the <br />execution of an Adoption Agreement and the satisfaction of certain other <br />requirements contained herein. <br />1.16 "Plan Administrator" shall mean the individual designated by position of <br />employment at the Employer to act on its behalf in all matters relating to the <br />Employer's participation in the Trust. <br />1.17 "Trust" shall mean the Public Agencies Post-Retirement Health Care Plan trust <br />arrangement. <br />1.18 "Trust Administrator" shall mean Public Agency Retirement Services or any <br />successor trust administrator appointed by the Employers as provided herein. The <br />Trust Administrator shall serve as trust administrator to the Trust established <br />pursuant to this Trust Agreement until such Trust Administrator resigns or is <br />removed as provided in Article III. <br />1.19 "Trust Agreement" shall mean this Public Agencies Post-Retirement Health <br />Care Plan trust document adopted by each Employer upon execution of an <br />Adoption Agreement, as amended from time to time. <br />1.20 "Trustee" shall mean Union Bank of California, N.A., or any successor trustee <br />appointed by the Employers as provided herein. The Trustee shall serve as trustee <br />of the Trust established pursuant to the provisions of this Trust Agreement until <br />such Trustee resigns or is removed as provided in Article III. <br />2 <br />N d I :657192.8 <br />
