Hollister <br />City Manager <br />Services Manag~ <br />ON: <br />RESOLUTION APPROVING A DISADVANTAGED BUSINESS ENTERPRISE (DBE) <br />PROGRAM IMPLEMENTATION AGREEMENT WITH CALIFORNIA DEPARTMENT OF <br />TRANSPORTATION (CALTRANS) FOR THE RECEIl'T OF FEDERAL HIGHWAY <br />FUNDS. <br />SUMMARY AND RECOMMENDATION <br />The Department of Transportation (Caltrans) recently revised its requirements for both itself and <br />Iocal agencies receiving Federal Transportation Funds. Caltrans is returning to a Disadvantaged <br />Business Enterprise (DBE) Program with a Race Conscious component. Each local agency is <br />required to enter into a Caltrans DBE Implementation Agreement, agree to conform to the <br />changes and amend its contract specifications to implement the new DBE program plan. <br />Attached to this report is the Caltrans Disadvantaged Business Enterprise Implementation <br />Agreement. <br />It is recommended that the City Council adopt a resolution authorizing the City Manager to sign <br />the Caltrans DBE Implementation Agreement. <br />BACKGROUND <br />The Federal Highway Administration (FHWA) approved the California Department of <br />Transportation's 2009 DBE Annual Overall Goal FHWA's approval requires the immediate <br />implementation of the new DBE Program that includes a Race Conscious component (RC DBE <br />Program). A Race Conscious DBE Program requires that DBE goals be used in all advertised <br />contracts for federally funded projects. The focus is to provide Underutilized Disadvantaged <br />Business Enterprises with a greater opportunity to participate in projects funded by the federal <br />government. With this directive, Caltrans is requiring that all local agencies who receive Federal <br />Highway Funds transition to the new RC DBE Program. <br />
