certificate of insurance and/or additional insured endorsement as required <br />in these specifications applicable to the renewed or new coverage must be <br />provided to City with five (5) days of the expiration of coverage. <br />4.4.4 Additional insured. Prior to the execution ofthis Agreement a certified <br />endorsement at least as broad as Insurance Services Office form number <br />CG 20 10 (07/04 ed.) shall be attached to the General Liability policy <br />stating that the City and its officers, employees, agents, and volunteers <br />shall be covered as additional insureds with respect to each of the <br />following: liability arising out of activities performed by or on behalf of <br />Consultant, including the insured's general supervision of Consultant; <br />products and completed operations of Consultant, as applicable; premises <br />owned, occupied, or used by Consultant; and automobiles owned, leased, <br />or used by the Consultant in the course of providing services pursuant to <br />this Agreement. The coverage shall contain no special limitations on the <br />scope of protection afforded to City or its officers, employees, agents, or <br />volunteers. Proof of compliance with these insurance requirements, <br />consisting of a Certificate of Insurance evidencing all of the coverages <br />required and an additional insured endorsement shall be attached to this <br />agreement prior to any work being executed. <br />a.d.5 Deductibles and Self-Insured Retentions. Consultant agrees not to self- <br />insure or to use any self-insured retentions or deductibles on any portion <br />of the insurance required herein and further agrees it will not allow any <br />contractor, subcontractor, Architect, Engineer or other entity or person in <br />any way involved in the performance of work on the project contemplated <br />by this agreement to self-insure its obligations to the City. If Consultant's <br />existing coverage includes a deductible or self-insurance retention, the <br />deductible or self-insured retention must be declared to the City. At that <br />time the City shall review options with the consultant, which may included <br />reduction or elimination of the deductible or self-insured retention, <br />substitution of other coverage or other solutions. Consultant shall disclose <br />to and obtain the approval of City for any self-insured retentions and <br />deductibles before beginning any of the services or work called for by any <br />term of this Agreement. <br />During the period covered by this Agreement, only upon the prior express <br />written authorization of Contract Administrator, Consultant may increase <br />such deductibles or self-insured retentions with respect to City, its officers, <br />employees, agents, and volunteers. The Contract Administrator may <br />condition approval of an increase in any deductible or self-insured <br />retention levels with a requirement that Consultant procure a bond, <br />guaranteeing payment of losses and related investigations, claim <br />administration, and defense expenses that is satisfactory in all respects to <br />each of them. <br />San Leandro Blvd-BART Interface Plan June, 2009 <br />8 of 38 <br />
