Borrower owns all that real property located in the City of San Leandro, <br />California, more particularly described in Exhibit A attached hereto (the <br />"Property"); <br />B. The City, Agency and Borrower have entered into the following documents <br />(collectively referred to as the "City and Agency Loan Documents"): <br />(i) Owner Participation and Loan Agreement among the City, <br />Agency and Borrower~d ted as of September 10, 2007, a Memorandum <br />of which was record~"d in the Official Records of Alameda County on <br />September 18, 2007 as Instrument No. 2007-334383 (the "OPA"); <br />(ii) Affordable Housing ,Regulatory Agreement and Declaration of <br />Restrictive Covenants amo~the City, Agency and Borrower, dated as of <br />September 10, 2007, and recorded on September 18, 2007, as Instrument <br />No. 2007-334384 ("City and~Agen~cy Regulatory Agreement"); <br />(iii) Deed of Trust by Bor- ~~iver for the benefit of the Agency dated <br />as of September 10, 2007 and recorded on September 18, 2007, as <br />Instrument No. 2007-334385 ("Agency Deed of Trust") securing a <br />Secured Promissory Note in favor of the Agency dated as of September <br />1219529-1 <br />
