Bob Taylor: That was the only thing at that time, because again, it was kind of a rehash <br />of the original EIR that came back through. And, we were not doing so much as a <br />mitigation factor as it was advising them that they weren't going to just come through <br />rip up a street and walk out by just filling the hole back up. That was presented and was <br />approved by Council on two different occasions where this came back through Council. <br />And, that was the mitigation that we said at that time. There is another EIR that will be <br />coming through on this project. There is also an encroachment permit that must be <br />issued. So, under an encroachment permit, the City has the ability to exact mitigations <br />for construction -when someone opens up your street, you can require them to pave <br />additional areas and those types of things. Under a separate EIR you can do it. Under <br />this agreement tonight, the City Council could say "this is what we want" and that would <br />be part of the record -Council Member Galvan would take that back to EBDA as part <br />of this agreement. This is a conceptual agreement -this is not the final document that's <br />here tonight. Basically, what's being asked is that if a document very similar to this - <br />substantially the same deal points are in it - to authorize your Council representative, <br />Councilman Galvan, to vote in favor of entering into an agreement with EBDA. The <br />final agreement would be hashed out -there's still some legal phrases that have to be <br />worked out. But, in general conformance with what is before you, that's what's being <br />asked for -not approval of this document specifically. So, if the Council wants to put <br />more specific mitigation factors in, they could give that specifically and then Councilman <br />Galvan, when he goes to EBDA, he could make that a part of it. <br />October 20, 1997 -Verbatim Transcript, Item 6.A 8 <br />
