IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION N0.2005-O1S (1123/2793) <br />RESOLUTION AUTHORIZING THE ALAMEDA COUNTY FIRE DEPARTMENT <br />TO PARTICIPATE IN THE SAFELY SURRENDERED BABY PROGRAM <br />AT SAN LEANDRO FIRE STATIONS <br />WHEREAS, the State Legislature has enacted Health and Safety Code § 1255.7 which <br />allows any person having lawful custody of a minor child 72 hours old or younger to surrender <br />physical custody of the child to an employee at a location designated by the County Board of <br />Supervisors; and <br />WHEREAS, the Alameda County Fire Department wishes to have San Leandro Fire <br />Stations 9, 10, ll, 12, and 13 so designated; and <br />WHEREAS, such designation is for the benefit of children and the community because it <br />will provide a safe haven to newborns who are 72 hours old or younger. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br />follows: <br />Section 1. That San Leandro Fire Stations 9, 10, 11, 12, and 13 may be designated by <br />Alameda County as locations which may accept newborns who are 72 hours old or younger from a <br />person who has lawful custody of the child. <br />Section 2. That the City Manager is authorized to request that the Board of Supervisors of <br />Alameda County designate San Leandro Fire Stations 9, 10, 11, 12, and 13 as locations which may <br />accept newborns who are 72 hours old or younger from a person who has lawful custody of the <br />child. <br />Section 3. That the City Manager is authorized to execute any documents which are <br />necessary to effectuate this designation and which are consistent with this Resolution. <br />Introduced by Councilmember Nardine and passed and adopted this 7`h day of February, <br />2005 by the following called vote: <br />Members of the Council: <br />AYES: Councilmembers Badger, Glaze, Grant, Nardine, Santos, Stephens; Mayor Young (7) <br />NOES: None (p) <br />ABSENT: None (p) <br />ATTEST: ~~`~~~ ~ ~~~~'~-- <br />Marian Handa, City Clerk <br />
