~.., ENVIIiONMENTAL CIIECKLIST <br />Measure B-2: Avoid disturbing active special-status raptor nests and other nesting birds. <br />If construction activities are scheduled to occur during the nonbreeding season (August 16 <br />through February 14), no mitigation is required. <br />if construction activities are scheduled to occur during the breeding season (February 15 through <br />August 15), the following measures are required prior to issuance of grading permits to avoid <br />potential adverse effects on nesting special-status raptors and other birds: <br />A qualified wildlife biologist will conduct preconstruction surveys of all potential nesting <br />habitat within 500 feet of construction activities. <br />If active nests are found during preconstruction surveys, a 500 foot no-disturbance buffer <br />will be created around active raptor nests and a 250 foot no-disturbance buffer will be <br />created around active nests of other nesting birds during the breeding season or until it is <br />determined that all young have fledged. The size of individual buffers can be adjusted <br />based on an evaluation of the site by a qualified biologist. The evaluation would be based <br />on ambient noise levels, the presence of topographical features that obstruct the line of site <br />from the construction activities to the nest, or observations of the nesting pair during <br />construction based on the level of ongoing disturbance (e.g., road traffic) and the observed <br />sensitivity of the birds. Site evaluations and buffer adjustments would be done in <br />consultation with the local CDFG representative. <br />If preconstruction surveys indicate that nests are inactive or potential habitat is unoccupied <br />during the construction period, no further mitigation is required. <br />Measure B-3: Implement the following measures to prevent impacts to jurisdictional <br />waters (including wetlands and watercourses): <br />^ Utilize bore and jack or other trenchless construction techniques to install pipeline at all <br />waterway and/or marsh crossings. <br />^ Prior to issuance of grading permits, a spill prevention plan for potentially hazardous <br />materials shall be prepared and implemented. The plan shall include the proper handling <br />and storage of all potentially hazardous materials, as well as the proper procedures for <br />cleaning up and reporting of any spills. <br />^ No refueling or fuel storage shall occur within 100 feet of waterways. <br />^ Proper and timely maintenance for vehicles and equipment used during construction shall <br />be provided to reduce the potential for mechanical breakdowns leading to a spill of <br />materials into or around waterways and wetlands. Maintenance and fueling will be <br />conducted in an area that meets the criteria set forth in the spill prevention plan (i.e., away <br />from waterways and wetlands). <br />^ A qualified biological monitor shall be on site during bore and jack activities. The <br />biological monitor will be authorized to halt construction if impacts to wetlands or <br />waterways are evident. <br />^ In the event that equipment needs to operate in any watercourse or wetland for any reason <br />(for example, cleanup of an accidental bentonite clay spill) the biological monitor would be <br />present at all times to alert construction crews to the possible presence of sensitive species <br />San Leandro Rccyckd Water Project 2-17 FSA ! ?A3193 <br />Drafr IS/MND <br />
