IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2005-034 (3042) RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LEANDRO CONSENTING TO THE USE OF REDEVELOPMENT AGENCY FUNDS, AWARD OF CONTRACT TO MCGUIRE & HESTER, AND APPROPRIATION OF CAPITAL IMPROVEMENT PROGRAM RESERVE FUNDS FOR THE WEST ESTUDILLO PEDESTRIAN CONNECTION PROJECT, PROJECT NO. 03-961-86-045 Recitals WHEREAS, California Redevelopment Law at Health and Safety Code Section 33445 provides that a redevelopment agency may, with the consent of the legislative body, pay all or a portion of the cost of the construction of any building, facility, structure, or other improvements which is publicly owned either within or without the project area; and WHEREAS, on December 5, 2002, the Redevelopment Agency of the City of San Leandro (the "Agency") issued $15,935,000 in Tax Allocation Bonds for the Plaza Redevelopment Project Area to assist in financing, in part, the West Estudillo Pedestrian Connection project; and WHEREAS, the City of San Leandro (the "City") did, on February 14, 2005, publicly open, examine and declare all sealed proposals or bids for doing the work described in Resolution No. 2004-172 of the City Council adopted on December 6, 2004, which resolution is hereby expressly referred to for a description of said work and for all particulars relative to the proceedings under said resolution; and WHEREAS, said proposals were submitted to the Engineering and Transportation Director of the City who has recommended that the proposal hereinafter mentioned is the lowest responsive bid for doing said work.
