IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2005-034 (3042) <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />CONSENTING TO THE USE OF REDEVELOPMENT AGENCY FUNDS, AWARD OF <br />CONTRACT TO MCGUIRE & HESTER, AND APPROPRIATION OF CAPITAL <br />IMPROVEMENT PROGRAM RESERVE FUNDS FOR THE WEST ESTUDILLO <br />PEDESTRIAN CONNECTION PROJECT, PROJECT NO. 03-961-86-045 <br />Recitals <br />WHEREAS, California Redevelopment Law at Health and Safety Code Section 33445 <br />provides that a redevelopment agency may, with the consent of the legislative body, pay all or a <br />portion of the cost of the construction of any building, facility, structure, or other improvements <br />which is publicly owned either within or without the project area; and <br />WHEREAS, on December 5, 2002, the Redevelopment Agency of the City of San <br />Leandro (the "Agency") issued $15,935,000 in Tax Allocation Bonds for the Plaza <br />Redevelopment Project Area to assist in financing, in part, the West Estudillo Pedestrian <br />Connection project; and <br />WHEREAS, the City of San Leandro (the "City") did, on February 14, 2005, publicly <br />open, examine and declare all sealed proposals or bids for doing the work described in <br />Resolution No. 2004-172 of the City Council adopted on December 6, 2004, which resolution is <br />hereby expressly referred to for a description of said work and for all particulars relative to the <br />proceedings under said resolution; and <br />WHEREAS, said proposals were submitted to the Engineering and Transportation <br />Director of the City who has recommended that the proposal hereinafter mentioned is the lowest <br />responsive bid for doing said work. <br />
