IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION N0.2005-035 (3024) <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />CONSENTING TO THE USE OF REDEVELOPMENT AGENCY FUNDS AND <br />AWARD OF CONTRACT TO BAY CITIES PAVING & GRADING, INC. FOR THE <br />MACARTHUR BOULEVARD STREETSCAPE PROJECT, PROJECT NO. 03-964-82-058 <br />Recitals <br />WHEREAS, California Redevelopment Law at Health and Safety Code Section 33445 <br />provides that a redevelopment agency may, with the consent of the legislative body, pay all or a <br />portion of the cost of the construction of any building, facility, stricture, or other improvements <br />which is publicly owned either within or without the project area; <br />WHEREAS, on June 16, 2004, the Redevelopment Agency of the City of San Leandro (the <br />"Agency") issued $5,500,000 in Tax Allocation Bonds for the West San Leandro/MacArthur <br />Boulevard Redevelopment Project Area to assist in financing, in part, the MacArthur Boulevard <br />Streetscape project; and <br />WHEREAS, the City of San Leandro ("City") did, on February 24, 2005, publicly open, <br />examine and declare all sealed proposals or bids for doing the work described in Resolution No. <br />2005-004 of the City adopted on January 18, 2005, which resolution is hereby expressly referred to <br />for a description of said work and for all particulars relative to the proceedings under said resolution; <br />WHEREAS, said proposals were submitted to the Engineering and Transportation Director <br />of the City who has recommended that the proposal hereinafter mentioned is the lowest responsive <br />bid for doing said work. <br />WHEREAS, the Agency has made the fmdings as required by Section 33445 and has <br />determined that no other means of financing the installation of the MacArthur Boulevard Streetscape <br />
