IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2005-036 (3050) <br />RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE REAL PROPERTY <br />AGREEMENTS FOR THE VARIOUS PROPERTIES REQUIRED FOR THE RAILROAD <br />CROSSING UPGRADE PROJECT, PROJECT NO. 230-38-207, FEDERAL-AID PROJECT <br />NO. HP21L-5041 (027) <br />Pursuant to Municipal Code Section 1-6-106, the City Manager is hereby authorized to <br />execute real property purchase agreements and all other related documents for the property <br />necessary for the Railroad Crossing Upgrade project when terms and conditions of such <br />acquisitions are within the fair market appraisal obtained by the City or the compensation paid is <br />otherwise fair, just and equitable. <br />Such property acquisitions are considered categorically exempt under California <br />Environmental Quality Act (CEQA) Section 15332 and a Notice of Exemption was filed. <br />Such property acquisitions are determined by the Planning Commission to be in <br />conformance with the City's General Plan under Government Code Section 65402 <br />NOW THEREFORE, the_ City Council of the City of San Leandro does RESOLVE as <br />follows: <br />That the City Manager is authorized to execute agreements for the purchase of property at <br />various locations for the Railroad Crossing Upgrade Project on behalf of the City of San <br />Leandro. <br />Introduced by Councilmember Stephens and passed and adopted this 21st day of March <br />2005, by the following called vote: <br />
