Luu, T. Tran and U. Wong (applicants/property owners) <br />THLS AGREEMENT is entered into by and between the CITY OF SAN LEANDRO, a municipal <br />corporation, hereinafter referred to as "City," and P. Luu, T. Tran and U. Wong, hereinafter <br />referred to as "Applicant" or "Property Owner". <br />Applicant applied for and received approval for Variance and Minor Site Plan review to subdivide <br />an existing 8,400 square-foot parcel into two parcels with 4,800 and 3,600 square feet each and <br />40 and 45 feet of lot width, respectively, on 240 Kenilworth Avenue and the vacant lot on Myers <br />Court and to build a 2,270 square foot two-story home on the Myers Court lot with 1,757 square <br />feet of livable area, a 402 square-foot garage and a 24 square-foot porch at the vacant lot on <br />Myers Court; Alameda County Assessor's Parcel Number 076-0299-041-00. <br />NOW, THEREFORE, pursuant to the applicable provisions of the Zoning Cade, it is <br />mutually agreed as follows: <br />1. Applicant agrees to comply with the Conditions of Approval adopted by the City of San <br />Leandro Board of Zoning Adjustments, more specifically described in the list of Conditions of <br />Approval, attached hereto, and as described in the exhibits on file in the Community Development <br />Department, all of which are incorporated herein by this reference. <br />2. This agreement shall be binding upon and inure to the benefit of the parties hereto and <br />their respective heirs, successors, and assigns. <br />3. City is authorized to record this agreement and any amendments thereto with the <br />Alameda County Recorder, California. All amendments hereto must be in writing and signed by <br />the appropriate authorities of the City and Applicant. The Applicant will be charged the costs of <br />Agreement to Conditions March 5, 2009 <br />PLN2008-00026 Page 1 of 8 <br />
