CONDITIONS OF APPROVAL <br />PLN2008-00026 <br />240 Kenilworth Avenue <br />Alameda County Assessor's Parcel Number 076-0299-041-00 <br />P. Luu, T. Tran, U. Wong (applicants/property owner) <br />L COMPLIANCE WITH APPROVED PLANS <br />A. The project shall comply with Exhibits A through G attached to the staff report <br />dated March 5, 2009, except as hereinafter modified. (Exhibits are on file at the <br />City of San Leandro, Community Development Department, 835 East 14th Street, <br />San Leandro, California, 94577). <br />Exhibit A -Tentative Parcel Map <br />Exhibit B -Plot Plan (A1) <br />Exhibit C -Proposed Floor Plans (A2) <br />Exhibit D -Proposed Elevations (A3) <br />Exhibit E -Proposed Electrical Plans (A4) <br />Exhibit F -Sections (AS) <br />Exhibit G - Streetscape <br />B. The developer shall be responsible for assuring that any successor in interest who <br />assumes responsibility for this zoning approval is informed of its terms and <br />conditions. <br />C. Construction shall commence within one (1) year following Board of Zoning <br />Adjustments approval and shall be substantially completed within one (1) year <br />thereafter. For the purpose of compliance with this condition, commencement of <br />construction shall be defined as the construction of a substantial portion of the <br />garage/foundation. <br />II. PERMITTED USE <br />A. This Variance and Minor Site Plan review is an approval to subdivide an existing <br />8,400 square-foot parcel into two parcels with 4,800 and 3,600 square feet each <br />and 40 and 45 feet of lot width, respectively, on 240 Kenilworth Avenue and the <br />vacant lot on Myers Court and to build a 2,270 square foot two-story home on the <br />Myers Court lot with 1,757 square feet of livable area, a 402 square-foot garage <br />and a 24 square-foot porch at the vacant lot on Myers Court; Alameda County <br />Assessor's Parcel Number 076-0299-041-00. <br />B. No application for amendment of the application or Conditions of Approval may <br />be submitted or accepted for processing by the City unless (i) there is full <br />compliance with all terms of the application and Conditions of Approval; or (ii) <br />the Community Development Director can waive compliance with the terms of the <br />application if they are minor in content. <br />Agreement to Conditions March 5, 2009 <br />PLN2008-00026 Page 3 of 8 <br />
