IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2005-060 (1123) RESOLUTION APPROVING DESIGNATION OF CERTAIN PROPERTIES ZONED COMMERCIAL DOWNTOWN (CD) AS A SPECIAL NEWSRACK DISTRICT IN ACCORDANCE WITH NEWSRACK REGULATION ORDINANCE NO. 2005-004 Recitals WHEREAS, in accordance with the provisions of Chapter 6 of Title 5 of the San Leandro Municipal Code, it has been recommended that properties zoned Commercial Downtown (CD) be designated as a Special Newsrack District, subject to the procedure contained in said Chapter; and WHEREAS, through adoption of the General Plan and Downtown Plan & Urban Design Guidelines, policy has been recommended for improving the streetscape aesthetics; and WHEREAS, currently the City is undertaking a number of streetscape enhancement projects including the history walk and downtown lighting and pedestrian enhancements; and WHEREAS, the legal basis for adoption of a newsrack ordinance is tied to regulations that address public safety and/or aesthetics; and WHEREAS, this Council has studied said recommendation, has considered the reasons designation of CD-zoned properties as a Special Newsrack District and has received and considered evidence at a public hearing thereon. NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: That the properties zoned Commercial Downtown (CD) as shown on Exhibit A, and dated April 12, 2004 are hereby designated as a Special Newsrack District and said properties shall be subject to the procedures for placement of newsracks in accordance with Chapter 6 of Title 5 of the San Leandro Municipal Code.
