IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2005-111 (3068) <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />CONSENTING TO THE USE OF REDEVELOPMENT AGENCY FUNDS AND APPROVAL <br />OF PLANS AND SPECIFICATIONS AND CALL FOR BIDS FOR DAMS STREET/EAST <br />14TH STREET LIGHTING AND PEDESTRIAN IMPROVEMENTS, <br />PROJECT NO. 03-961-83-062 <br />Recitals <br />WHEREAS, California Redevelopment Law at Health and Safety Code Section 33445 <br />provides that a redevelopment agency may, with the consent of the legislative body, pay all ar a <br />portion of the cost of the construction of any building, facility, structure, or other improvement, <br />which is publicly owned either within or without the project area; and <br />WHEREAS, on December 5, 2002, the Redevelopment Agency of the City of San <br />Leandro (the "Agency") issued $15,935,000 in Tax Allocation Bonds for the Plaza <br />Redevelopment Project Area to assist in financing, in part, the Davis Street/East 14th Street <br />Lighting and Pedestrian Improvement project; and <br />WHEREAS, the Agency has made the findings required by section 33445 and has <br />determined that no other means of financing the installation of the Davis Street/East 14th Street <br />Lighting and Pedestrian Improvements project is available to the community in that the only <br />other possible source of funding is through the use of the City's General Fitnd, which is pledged <br />for the provision of essential city services for the residents of the City. <br />WHEREAS, the City Council of the City of San Leandro has reviewed and considered <br />the Categorical Exemption prepared for the Davis Street!East 14th Street Lighting and Pedestrian <br />Improvements, Project No. 03-961-83-062, and any comments received, and hereby finds that <br />the project will not have a significant effect on the environment; and <br />
