IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2005-114 (2323) RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LEANDRO CONSENTING TO THE USE OF REDEVELOPMENT AGENCY FUNDS AND APPROVAL OF A CONTRACTUAL SERVICES AGREEMENT WITH HARRIS & ASSOCIATES FOR THE EAST 14TH STREET MEDIAN PROJECT, PROJECT NO. 150-38-228 Recitals WHEREAS, California Redevelopment Law at Health and Safety Code Section 33445 provides that a redevelopment agency may, with the consent of the legislative body, pay all or a portion of the cost of the construction of any building, facility, structure, or other improvement, which is publicly owned either within or without the project area; and WHEREAS, the Agency has made the findings required by Section 33445 and has determined that no other means of financing, in part, the East 14t" Street Median Project is available to the community in that the only other possible source of funding is through the use of the City's General Fund, which is pledged for the provision of essential city services for the residents of the City. WHEREAS, an agreement between the City of San Leandro and Harris & Associates, a copy of which is attached hereto, has been presented to this Council; and The City Council is familiar with the contents thereof; and The City Manager has recommended the approval of said document, and NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE, DECLARE, DETERMINE, AND ORDER, as follows: SECTION 1. The City Council of the City of San Leandro hereby specifically finds that all of the facts stated above are true and correct.
