~ .;c~~~;~; a f I °7 FUNDING AGREEMENT Between METROPOLITAN TRANSPORTATION COMMISSION And CITY OF SAN LEANDRO For' LIFT FUNDS THIS AGREEMENT is made and entered into as of the 16th day of February, 2005, by and between the Metropolitan Transportation Commission (herein called "MTC"), a regional transportation planning agency established pursuant to California Government Code §66500 et seq., and City of San Leandro (herein called "RECIPIENT"). WITNESSETH WHEREAS, MTC has determined that providing the San Leandro LINKS Shuttle ("the Project") would assist low-income individuals in achieving self-sustainability by obtaining and maintaining employment; WHEREAS, MTC established the Low Income Flexible Transportation (LIFT) Program; and WHEREAS, MTC has agreed to provide funding for this service with State Transit Assistance (STA) funds; and WHEREAS, MTC adopted MTC Resolution No. 3291, establishing the screening criteria, and project evaluation process and schedule for the LIFT program; and WHEREAS, MTC amended MTC Resolution No. 3518, establishing the current program of LIFT projects; NOW, THEREFORE, the parties hereto agree as follows: SCOPE OF WORK RECIPIENT agrees to perform or to engage a contractor to perform the project activities described in Attachment A, Scope of Work, attached hereto and incorporated herein by this reference as though set forth in full. RECIPIENT agrees, in addition, to provide all necessary staff support to deliver the project activities in Attachment A. 2. TIME OF PERFORMANCE The services funded by this Agreement shall commence on or after February 16, 2005, and RECIPIENT shall complete them by February 15, 200'1, unless earlier terminated as hereinafter provided.
