Materials which the Police Chief considers objectionable will not be posted, <br />provided, however, the Police Chief shall first discuss and receive concurrence from <br />the Municipal Employee Relations Officer. <br />(4) The City reserves the right to determine where bulletin boards shall be placed and <br />what portions of them are to be allocated to employee organizations' materials. <br />(5) An employee organization that does not abide by these rules shall be subject to <br />forfeiture of its right for a period of thirty (30) days to have materials posted on City <br />bulletin boards. <br />Section 5. City Rights <br />The rights of the City include, but are not limited to, the exclusive right to determine the mission of <br />its constituent departments, commissions and boards; set standards of service; determine the <br />procedures and standards of selection for employment and promotion; direct its employees; take <br />disciplinary action; relieve its employees from duty because of lack of work or for other legitimate <br />reasons; maintain the efficiency of governmental operations; determine the methods, means and <br />personnel by which government operations are to be conducted; determine the content of job <br />classifications; take all necessary actions to carry out its mission in emergencies; and exercise <br />complete control and discretion over its organization and the technology of performing its work. <br />Section 6. Pay and Classification <br />The recognized classifications and those rates of pay, which are to be effective during the period of <br />this Memorandum of Understanding, are enumerated in Appendix "A" which is attached hereto and <br />made a part hereof. <br />The rates of pay outlined in Appendix "A" include the following adjustments: January 1, 2006, a <br />five percent (5%) across the board wage increase. These increases are inclusive of both across the <br />board and market adjustments. <br />The City will maintain a twenty percent (20%) differential between the rank of Officer and <br />Sergeant. <br />Section 7. Overtime Compensation <br />Overtime work is authorized time of one-quarter hour or more worked in excess of that period <br />considered as a full week's work in the classification. <br />When first authorized by the Police Chief or designee, and with approval of the City Manager, <br />overtime worked shall be paid at the rate of one and one-half times the hourly rate based on the <br />employee's monthly salary. For the purpose of overtime-minimum pay, "Required call out" is <br />defined as an event for which an officer's assistance is required. With the exception of court <br />appearances, the event referred to in the preceding sentence is one that is not anticipated and <br />therefore unscheduled and not contiguous to the regular work shift. For required call out or court <br />appearance on a normal work day, a minimum three (3) hours' pay at the overtime rate will be paid <br />for the first such call out or court appearance, provided, however, that court appearances <br />immediately before or after scheduled duty hours shall be deemed an extension of the shift and the <br />4 <br />
