<br />struct, operate, and maintain public park access to OYSTER BAY REGIONAL SHORELINE <br />shall be irrevocable for and terminate twenty-five (25) years from the date hereof. <br />Such initial term may be renewed by DISTRICT, upon written notice given at least <br />six (6) months prior to the end of such initial term, for an additional twenty-five <br />(25) year term. <br />3. CITY and DISTRICT acknowledge that DISTRICT shall provide to the CITY, <br />for the CITY'S benefit, on demand of the CITY, other real property in the amount of <br />twice the area of licensed property, selected by DISTRICT and approved by CITY as <br />suitable for "mitigation" purposes in the event that the licensed property cannot <br />be utilized by the CITY for such purpose. The CITY shall not make such demand upon <br />DISTRICT for such mitigation unless and until one or more other governmental agen- <br />cies having legal jurisdiction to enforce such demand has made such demand upon the <br />CITY. In that event, the DISTRICT shall have a period of one year from such written <br />notice and demand by CITY to select and provide suitable mitigation properties <br />elsewhere for the CITY'S benefit in the amount of two times the area of the licensed <br />property. <br />4. DISTRICT shall submit to CITY all plans and specifications required for <br />construction of the access way including landscaping and improvements, to CITY and <br />CITY shall have a period of sixty (60) days from the receipt of such plans, speci- <br />fications, landscaping detail, and improvements to promptly review and determine that <br />such plans, specifications, landscaping detail, and improvements are within all <br />CITY'S ordinances, rules, and regulations, if any. DISTRICT shall, upon request of <br />CITY, submit evidence that all necessary permits and approvals from appropriate local, <br />regional and state agencies have been obtained in connection ~•~ith such plans, speci- <br />fications, landscaping detail, and improvements•as a part of the review of said data <br />by CITY. <br />5. Upon completion of the improvements, DISTRICT shall maintain the said <br />real property in a clean and presentable condition, and if DISTRICT fails so to <br />-2- <br />
