IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2005-163 (3066) <br />RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE REAL PROPERTY <br />AND USE AGREEMENT(S) FOR PROPERTY REQUIRED FOR THE <br />SENIOR CENTER PROJECT, PROJECT NO. 165-43-192 <br />Pursuant to Municipal Code Section 1-6-106, the City Manager is hereby authorized to <br />execute real property purchase agreements and all other related documents for the property <br />necessary for the Senior Center project when terms and conditions of such acquisitions are <br />within the fair market appraisal obtained by the City or the compensation paid is otherwise fair, <br />just, and equitable. <br />Such property acquisitions are considered categorically exempt under California <br />Environmental Quality Act (CEQA) Section 15332 and a Notice of Exemption will be prepared <br />and filed prior to acquisition. An Environmental Assessment pursuant to NEPA was prepared <br />for the project in July 2004, and a Finding of No Significant Impact was made. <br />Such property acquisitions are determined by the Planning Commission to be in <br />conformance with the City's General Plan under Government Code Section 65402. <br />NOW THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br />follows: <br />That the City Manager is authorized to execute an agreement for the acquisition of <br />property at the location required for the Senior Center Project on behalf of the City of San <br />Leandro. <br />Introduced by Councilmember Badger and passed and adopted this 19th day of <br />December, 2005, by the following called vote: <br />
