8. The inspection of the Project will be by a mutually agreed upon independent inspection firm overseen by San Leandro, with additional inspection support to be provided by each Party for portions of the Project that are in their respective jurisdictions. Each of the Parties shall have access to any inspection reports produced by the inspection firm. All communications related to the supplemental inspections shall be presented to the San Leandro Project Administrator for implementation. 9. San Leandro will act as the lead agency for the Project. The Parties shall have regular meetings throughout the construction of the Project, and each Party will assign staff to participate in all scheduled meetings. Notice of meetings shall be provided at least ten working days in advance of the meetings. Matters of an urgency or emergency shall be conducted outside of the regular meetings by way of conference calls with written follow up to all parties. 10. The Parties agree to cooperate in establishing a schedule for completion of the Project, and each Party will thereafter be required to act in accordance with that schedule. The schedule may thereafter be modified with the written consent of all the Parties. Parties acknowledge that time is of the essence in regards to all matters impacting the construction schedule. Modifications to schedule shall not be made that impact the construction schedule, once the contract has been awarded. 11. Each Party agrees to provide maintenance of Project improvements constructed hereunder as delineated by the areas specified in Exhibit A. Improvements shall be kept in good working order, free of graffiti and litter The landscaping shall be maintained pest, weed, and disease free in accordance with sound horticultural practices. Trees shall be maintained in accordance with standards established by the International Society of Arborculture. 12. Port shall coordinate with Galbraith Golf Course concessionaires to ensure coordination of plan approval, work schedule and construction, so as to avoid conflicts and achieve efficiencies with the construction of the Project. Local Preference Programs 13. As used herein, "Local Preference Program" refers to the City of Oakland Small and Local Business Enterprise Program and Local Employment Program. 14. Local Preference Programs shall apply to the award of Project construction contracts and the employment of workers on Project construction. San Leandro and Oakland shall each be responsible for and bear its own costs in determining whether a bidder qualifies for a preference under their respective programs, and whether a contractor is complying with employment requirements.
