IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2004-063 (2056) <br />RESOLUTION AUTHORIZING IMPLEMENTATION OF A <br />MILLS ACT PROGRAM FOR THE CITY OF SAN LEANDRO <br />RECITALS <br />A. The City has adopted a Historic Preservation Ordinance (San Leandro Municipal <br />Code Chapter 4-26) to provide for the identification, designation, enhancement, <br />perpetuation, and use of historical resources in the City. <br />B. The City Council has identified the following reasons for reasons for adoption of the <br />Historic Preservation ordinance: <br />(a) To encourage public knowledge, understanding, appreciation, and use of the <br />city's past; <br />(b) To foster civic pride in the beauty and character of the city and in the <br />accomplishments of its past; <br />(c) To enhance the visual character of the city by encouraging the preservation of <br />resources important in the city's past; <br />(d) To increase the economic benefits of historic preservation to the city and its <br />inhabitants; <br />(e) To protect property values within the city; <br />(f) To identify as early as possible and resolve conflicts between the preservation <br />of historical resources/districts and alternative land uses; <br />(g) To conserve valuable material and energy resources by ongoing use and <br />maintenance of the existing built and natural environment; and <br />(h) To provide property owners with monetary and other incentives to ensure that <br />individual property owners are encouraged to voluntarily participate in the <br />preservation of their property and city. <br />C. Section 4-26-1900 of the Historic Preservation Ordinance provides that the Library- <br />Historical Commission shall develop and maintain an incentive program approved by <br />the City Council that will be available to property owners of designated historic <br />properties to encourage historic preservation, and investment, improvement, and <br />maintenance of historic properties. <br />D. The Library-Historical Commission has developed, and the City Council has <br />approved, an incentive program that includes making available the benefits of the <br />Mills Act to owners of qualified historic resources. <br />E. The Mills Act, Government Code section 50280 et seq. provides cities with the <br />opportunity to contract with owners of qualified historic resources whereby the owner <br />promises to preserve, restore, and rehabilitate the property in return for a reduced <br />property tax. <br />
