IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2004-070 (3017) <br />RESOLUTION OF NECESSITY DETERMINING THAT THE PUBLIC INTEREST AND <br />NECESSITY REQiJIlZE THE ACQUISITION OF CERTAIN LAND AND DIRECTING THE <br />FILING OF EMINENT DOMAIN PROCEEDINGS FOR AN EASEMENT OVER A <br />PORTION OF THE PROPERTY LOCATED AT 1312/1316 HUBBARD AVENUE (APN <br />080H-1586-035-00), PROPERTY OWNERS: ION & MARIOARA NEAGU AND SAMY & <br />ZAMFIIZA VUNDERMAN; FOR CONSTRUCTION OF A STORM DRAIN EASEMENT FOR <br />THE MANOR BRANCH LIBRARY PROJECT <br />IT IS RESOLVED by the City Council of the City of San Leandro as follows: <br />WHEREAS, it is desirable and necessary for the City of San Leandro to acquire certain <br />real properly, particularly described in Exhibit "A", attached hereto and made a part hereof by <br />reference, for public purposes, to with: for the construction of improvements at the Manor <br />Branch Library at 1241 Manor Boulevard. The names and addresses of the owners who have <br />interest to be acquired are as follows: <br />Ion and Marioara Neagu: 15207 Norton Street, San Leandro, CA 94579-2126 <br />Samy and Zamfira Vunderman: 4110 Sugar Maple Drive, Danville, CA 94506 <br />WHEREAS, the City of San Leandro is vested with the power of eminent domain to <br />acquire real property by virtue of Article I, Section 19, of the Constitution of the State of <br />California, and Sections 1240.050, 1240.110, 1240.120, 1240.125, 1240.150, and 1240.410 of <br />the Code of Civil Procedure of the State of California; and <br />WHEREAS, pursuant to the provisions of Section 1245.235 of the Code of Civil <br />Procedure of the State of California, notice has been duly given to all persons whose property is <br />to be acquired by eminent domain and whose names and addresses appear on the last Alameda <br />County equalized assessment roll, all of whom have been given a reasonable opportunity to <br />
