IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2004-070 (3017) RESOLUTION OF NECESSITY DETERMINING THAT THE PUBLIC INTEREST AND NECESSITY REQiJIlZE THE ACQUISITION OF CERTAIN LAND AND DIRECTING THE FILING OF EMINENT DOMAIN PROCEEDINGS FOR AN EASEMENT OVER A PORTION OF THE PROPERTY LOCATED AT 1312/1316 HUBBARD AVENUE (APN 080H-1586-035-00), PROPERTY OWNERS: ION & MARIOARA NEAGU AND SAMY & ZAMFIIZA VUNDERMAN; FOR CONSTRUCTION OF A STORM DRAIN EASEMENT FOR THE MANOR BRANCH LIBRARY PROJECT IT IS RESOLVED by the City Council of the City of San Leandro as follows: WHEREAS, it is desirable and necessary for the City of San Leandro to acquire certain real properly, particularly described in Exhibit "A", attached hereto and made a part hereof by reference, for public purposes, to with: for the construction of improvements at the Manor Branch Library at 1241 Manor Boulevard. The names and addresses of the owners who have interest to be acquired are as follows: Ion and Marioara Neagu: 15207 Norton Street, San Leandro, CA 94579-2126 Samy and Zamfira Vunderman: 4110 Sugar Maple Drive, Danville, CA 94506 WHEREAS, the City of San Leandro is vested with the power of eminent domain to acquire real property by virtue of Article I, Section 19, of the Constitution of the State of California, and Sections 1240.050, 1240.110, 1240.120, 1240.125, 1240.150, and 1240.410 of the Code of Civil Procedure of the State of California; and WHEREAS, pursuant to the provisions of Section 1245.235 of the Code of Civil Procedure of the State of California, notice has been duly given to all persons whose property is to be acquired by eminent domain and whose names and addresses appear on the last Alameda County equalized assessment roll, all of whom have been given a reasonable opportunity to
