IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2004-082 (1009/1099) RESOLUTION ADOPTING A MITIGATED NEGATIVE DECLARATION AND ASSOCIATED MITIGATION MONITORING PROGRAM FOR PLN2004-00031 AS COMPLETE AND IN COMPLIANCE WITH CEQA FOR 1016-1052 DAMS STREET; (APNS: 075-0148-05, 075-0148-06-01, 075-0148-07, 075-0148-08-02) Recitals and Findings The City Council of the City of San Leandro finds that the foregoing recitals are true and correct and made a part of this resolution: A. There has been submitted to this Council an Initial StudylMitigated Negative Declaration (Exhibit A) and a Mitigation Monitoring Program (Exhibit B). B. The City Council considered the Mitigated Negative Declaration and Mitigation Monitoring Program, and comments submitted on the Mitigated Negative Declaration prior to taking action on the project. C. The potential environmental effects of the Firehouse Office Center project have been analyzed in the Initial Study/Mitigated Negative Declaration, which determined that the project will not have a significant effect on the environment with the application of mitigation measures identified in the Mitigated Negative Declaration and application of standard conditions of approval. The mitigation measures are also reflected in a Mitigation Monitoring Program, which ensures the mitigation measures will be implemented through development of the Firehouse Office Center project. There is no substantial evidence in light of the whole record before the City that the project, as mitigated, could have a significant effect on the environment. D. The Mitigated Negative Declaration reflects the City Council's independent judgment and analysis as to the environmental effects of the Firehouse Office Center project. E. The location and custodian of the documents which constitute the record of proceedings for the project is the City of San Leandro, 835 E. 14th Street, San Leandro. The custodian of these documents is: Debbie Pollart, Planning Manager, Cornrnunity Development Department. F. The Mitigated Negative Declaration is complete and adequate, and has been completed in compliance with CEQA and the CEQA Guidelines.
