IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2004-082 (1009/1099) <br />RESOLUTION ADOPTING A MITIGATED NEGATIVE DECLARATION AND <br />ASSOCIATED MITIGATION MONITORING PROGRAM FOR PLN2004-00031 AS <br />COMPLETE AND IN COMPLIANCE WITH CEQA FOR 1016-1052 DAMS STREET; <br />(APNS: 075-0148-05, 075-0148-06-01, 075-0148-07, 075-0148-08-02) <br />Recitals and Findings <br />The City Council of the City of San Leandro finds that the foregoing recitals are true and correct <br />and made a part of this resolution: <br />A. There has been submitted to this Council an Initial StudylMitigated Negative Declaration <br />(Exhibit A) and a Mitigation Monitoring Program (Exhibit B). <br />B. The City Council considered the Mitigated Negative Declaration and Mitigation <br />Monitoring Program, and comments submitted on the Mitigated Negative Declaration <br />prior to taking action on the project. <br />C. The potential environmental effects of the Firehouse Office Center project have been <br />analyzed in the Initial Study/Mitigated Negative Declaration, which determined that the <br />project will not have a significant effect on the environment with the application of <br />mitigation measures identified in the Mitigated Negative Declaration and application of <br />standard conditions of approval. The mitigation measures are also reflected in a <br />Mitigation Monitoring Program, which ensures the mitigation measures will be <br />implemented through development of the Firehouse Office Center project. There is no <br />substantial evidence in light of the whole record before the City that the project, as <br />mitigated, could have a significant effect on the environment. <br />D. The Mitigated Negative Declaration reflects the City Council's independent judgment and <br />analysis as to the environmental effects of the Firehouse Office Center project. <br />E. The location and custodian of the documents which constitute the record of proceedings <br />for the project is the City of San Leandro, 835 E. 14th Street, San Leandro. The custodian <br />of these documents is: Debbie Pollart, Planning Manager, Cornrnunity Development <br />Department. <br />F. The Mitigated Negative Declaration is complete and adequate, and has been completed in <br />compliance with CEQA and the CEQA Guidelines. <br />
