IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION N0.2004-083 (1003) <br />RESOLUTION APPROVING AGREEMENT <br />BETWEEN CITY OF SAN LEANDRO AND ABAG POWER FOR <br />CONSIDERATION OF ELECTRIC PROGRAM WIl~IDUP AGREEMENT <br />WHEREAS, City of San Leandro was a member of the ABAG POWER Electric <br />Aggregation Program; and <br />WHEREAS, the ABAG POWER Electric Aggregation Program was suspended on June <br />30, 2001; and <br />WHEREAS, ABAG POWER has retained certain funds owed to City of San Leandro as an <br />offset to certain risks and potential liabilities that would otherwise pass to the agency; and <br />WHEREAS, ABAG POWER has received authorization from its Board of Directors to <br />wind up the program and distribute remaining funds to members, while at the same time passing <br />any remaining risks to members as well. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br />follows: <br />That said agreement and delivery of the Electric Program Windup Agreement is hereby <br />approved and execution thereof is hereby authorized. <br />Introduced by Councilmember Stephens and passed and adopted this 7th day of June, 2004 <br />by the following called vote: <br />Members of the Council: <br />AYES: Councilmembers Badger, Glaze, Grant, Nardine, Santos, Stephens; Mayor Young (7) <br />NOES: None (0) <br />ABSENT: None <br />ATTEST: '-~`~.~1~-~M - <br />(0) <br />Marian Handa, City Clerk <br />
