WHEREAS, the City of San Leandro is engaged in the TLC Pedestrian Connection <br />project at the Washington Plaza Shopping Center, which is designed in part to draw people into <br />the shopping area; and <br />WHEREAS, as part of the completion of the TLC Pedestrian Connection project, a storm <br />drain and the footing for an entryway archway (the "Improvements") need to be installed on a <br />portion of the property located at 1267 Washington Avenue in San Leandro, APN 075-0226-003 <br />(the "Property"); and <br />WHEREAS, the Redevelopment Agency of the City of San Leandro desires to assist in <br />the completion of the TLC Pedestrian Connection project by purchasing the Property with <br />Redevelopment Agency funds to allow for the installation of the storm drain and archway <br />footing; and <br />WHEREAS, Regency Centers, LP has agreed to execute and deposit into escrow a grant <br />deed conveying the Property to the Agency; and <br />WHEREAS, the Property is located in the Plaza Redevelopment Project Area ("Project <br />Area"); and <br />WHEREAS, in order for the Improvements to be installed on the Property, the Agency <br />needs to acquire a Temporary Construction Easement on that portion of 1267 Washington <br />Avenue which the Agency will not purchase from Regency Centers, LP; and <br />WHEREAS, as a condition of approval of the Purchase and Sale Agreement for the <br />Property, Regency has agreed to grant a Temporary Construction Easement to the Agency and <br />the City of San Leandro on that portion of 1267 Washington Avenue which the Agency will not <br />purchase from Regency Centers, LP; and <br />RE50LUTION NO. 2004-101 2 <br />
