IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION N0.2004-111 (1055/1423/3006) <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LEANDRO CALLING A <br />SPECIAL NILJNICIPAL ELECTION FOR SUBMISSION OF A QUESTION TO THE <br />QUALIFIED VOTERS RELATING TO A CHARTER AMENDMENT TO PROVIDE THAT <br />THE TERM OF OFFICE FOR COUNCIL MEMBERS AND MAYOR SHALL COMMENCE <br />JANUARY 1 FOLLOWING THE ELECTION; CONSOLIDATING THE SPECIAL MUNICIPAL <br />ELECTION WITH THE GENERAL MUNICIPAL ELECTION TO BE HELD TUESDAY, <br />NOVEMBER 2, 2004; APPROVING THE FORM OF THE BALLOT QUESTION; SETTING <br />FORTH PROCEDURES FOR BALLOT ARGUMENT AND DIRECTING THE CITY CLERK <br />TO SUBMIT THE MEASURE TO THE CITY ATTORNEY FOR IMPARTIAL ANALYSIS <br />WHEREAS, under the provisions of the Charter, a General Municipal Election shall be held <br />on November 2, 2004, for the election of Municipal Officers; and <br />WHEREAS, the City Council also desires to call a Special Election to submit to the voters <br />at the election a question relating to an amendment to the Charter of San Leandro to provide that <br />the term of office for the office of Mayor and City Councilmembers shall commence on January 1 <br />following the election, in conformity with Section 1-11-105 of the San Leandro Municipal Code; <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN LEANDRO, <br />CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: <br />SECTION 1. The City Council hereby calls a Special Municipal Election of the qualified <br />voters of the City of San Leandro, to be held on November 2, 2004 to submit to the voters an <br />amendment to the City Charter to provide for a four year term of office commencing January 1 <br />following the election (attached as Exhibit "A"). <br />SECTION 2. The ballot measure shall appear and be printed upon the ballots to be used at <br />the Election as follows: <br />Shall the City of San Leandro Charter be amended to provide for a fixed four-year term of YES <br />office for Council Members and the Mayor commencing on January 1 following the <br />election? <br />NO <br />SECTION 3. Pursuant to the provisions of the Elections Code of the State of California, <br />the City Council of the City of San Leandro hereby requests that the Special Municipal Election of <br />the City of San Leandro to consider this measure be held November 2, 2004, in conjunction with <br />and to be consolidated with the General Municipal Election for the City of San Leandro and the <br />statewide election to beheld in the City of San Leandro on said date, and further requests the Board <br />of Supervisors of the County of Alameda to make its order of consolidation and thereafter call said <br />consolidated election, and to direct the Alameda County Registrar to conduct all necessary services <br />related to said election and to bill the City for the cost of conducting said election. <br />
