IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2004-132 (2047/2959) <br />RESOLUTION AUTHORIZING THE SUBMITTAL OF AN APPLICATION TO THE <br />BAY AREA AIR QUALITY MANAGEMENT DISTRICT FOR A TRANSPORTATION FUND <br />FOR CLEAN AIR GRANT IN THE AMOUNT OF $216,000 FOR FISCAL YEAR 2004-2005 <br />WHEREAS, the California Air Resources Board (GARB) has declared diesel particulate <br />matter (PM) to be a toxic air contaminant; and <br />WHEREAS, on September 25, 2003 the CARE adopted Resolution 03-21 to reduce diesel <br />particulate matter from on-road heavy duty and commercial solid waste collection vehicles; and <br />WHEREAS, the City of San Leandro has an exclusive franchise with Alameda County <br />Industries (ACI) to collect solid waste from residents and businesses; and <br />WHEREAS, the Bay Area Air Quality Management District (BAAQMD) is authorized to <br />make Transportation Fund for Clean Air Regional Funds available to public agencies for the <br />purposes of reducing air pollution from motor vehicles; and <br />WHEREAS, the City of San Leandro, if awarded, will use said funds to retrofit ACI solid <br />waste collection vehicles with a device verified by the GARB to reduce emissions in accordance <br />with Resolution 03-21; and <br />WHEREAS, procedures established by the BAAQMD require that the applicant's <br />governing body certify by resolution be approval of the grant application; <br />NOW, THEREFORE, BE IT RESOLVED that the City of San Leandro authorizes the <br />submittal of an application to the Bay Area Air Quality Management District for a Transportation <br />Fund for Clean Air Grant for Fiscal Year 2004-2005. <br />BE IT FURTHER RESOLVED that the Assistant Public Works Director is hereby <br />authorized to execute in the name of the City of San Leandro all necessary applications, contracts, <br />payment requests, agreements and amendments hereto for the purposes of securing grant funds and <br />
