IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2004-140 (2888) <br />RESOLUTION MODIFYING PLN2004-00031 A PLANNED DEVELOPMENT OF <br />APPROXIlvIATELY 9,640 SQUARE FEE OF OFFCE USES FOR 1016-1052 DAMS STREET <br />(ASSESSOR'S PARCEL NUMBERS 075-0148-05, 075-0148-06-01, 075-0148-07, AND <br />075-0148-08-02) <br />RECITALS <br />A. The Planning Commission and the City Council have approved a rezoning of the four subject <br />properties to CN(PD) Commercial Neighborhood, Planned Development Overlay District, <br />approved a planned development, approved a general map amendment and conformity findings, <br />and adopted associated environmental documents. <br />B. At the request of the applicant's lender, the applicant has requested the City to amend the planned <br />development approval to allow for a single two-story building. <br />C. The Planning Commission, on September 9, 2004, recommended approval of this amendment to <br />the City Council. <br />FINDINGS <br />A. The project as presented to the City Council in the Site Plan & Elevations and associated <br />documents conforms to the General Plan. <br />B, This project is exempt from further environmental review and the scope of the project as <br />amended is consistent with and falls within the scope of the Negative Declaration approved by <br />the City Council on June 7, 2004. <br />NOW THEREFORE, be it resolved by the City Council of the City of San Leandro the modification of <br />FLN2004-00031 is approved. <br />Introduced by Councilmember Santos and passed and adopted this 20~' day of September, 2004, by <br />the following called vote. <br />Members of the Council: <br />AYES: Councilmembers Badger, Grant, Nardine, Santos, Stephens; Mayor Young (6) <br />NOES: None (0) <br />ABSENT: Councilmember Glaze (1) <br />ATTEST: <br />Marian Handa, City Clerk <br />
