expenses thereof chargeable upon the area included within the Assessment District, and to form <br />the Assessment District. <br />SECTION 6. The City Council further declares its intention to levy a special <br />assessment upon the land within the Assessment District in accordance with the respective <br />special benefit to be received by each parcel of land from the Improvements. There shall be <br />omitted from special assessment all public streets, alleys, and places and all land belonging to the <br />United States of America, the State of California, the County of Alameda, the City of San <br />Leandro, or any other public agency of the State of California, which land is now in use in the <br />performance of a public function. <br />SECTION 7. The City Engineer is hereby authorized and directed to make and file <br />with the City Clerk a written report with regard thereto, which report shall comply with the <br />requirements of Section 10204 of the Streets and Highways Code. The Engineer's Report shall <br />be made a part of the record of the public hearing specified below. <br />SECTION 8. Following the construction and installation of the Improvements and the <br />payment of all incidental expenses, any surplus remaining in the improvement fund established <br />for the Assessment District shall be used as determined by the City Council as provided in <br />Section 10427 of the Streets and Highways Code. <br />SECTION 9. Election. The levy of the Special Tax lien shall be subject to the <br />approval of the qualified electors of the Assessment District (AD) at a special election. The <br />proposed voting procedure shall be by mailed or hand-delivered ballot among the landowners in <br />the proposed AD, with each owner having one vote for each lot such owner owns in the AD. <br />The Council hereby determines that the Facilities are necessary to improve as per City standards. <br />SECTION 10. Special Tax. It is the intention of this Council, acting as the legislative <br />body for the AD, that City will finance in whole the construction of the Facilities. <br />RESOLUTION NO. 2004-151 3 <br />
