3. Removal of Private Pro~ertv Aerial Distribution Facilities. City shall make <br />an-angements for the concurrent removal of ail private prope~~ty aerial distribution <br />facilities «~ithin the District. <br />4. Enviroiul~ental Imt~act Reports'Suspension of V~'ork. <br />a. As used herein, the term "Hazardous Material" means any hazardous or <br />tonic substance, material. waste, or petroleum product including, but not <br />limited to, (i) those listed in the Comprehensi~ e >/nvironlmental Response, <br />Compensation and Liability Act of 1980, as amended, 42 U.S.C. ~ 9601 et <br />seg.; the Toxic Substances Control Act, I~U.S.C. ~ 2601 et se .; the <br />Hazardous Materials Transportation Act, 49U.S.C. ~ 1801 et seq.; the <br />Resource Conservation and Recovery Act, 42 U.S.C. ~ 6901 et seq.; the <br />united States Department of Transportation Hazardous Materials Table <br />(49 C.>=.R. ~ 172.101), any similar state or local lav<~, or any other <br />regulation, compliance or guidance documents promulgated pursuant to <br />such laves, (ii) those items defined as hazardous materials by the Lnite~d <br />States Environmental Protection Agency in 40 C.F.R. Part 302, and (iii) <br />any other substances, materials, and wastes that are or become regulated <br />under any local, state, or federal law. <br />b. City, at City's expense. shall comply with all local, state, and federal laws, <br />rules, ordinances, orders, and requirements pertaining to Hazardous <br />Substances including, but not limited to, the California Environmental <br />Quality Act, the California Coastal Act, the California Land Conservation <br />Act, the Colmprehensive Em ironmental Response Compensation and <br />Liability Act. and the Resource Conservation Recovery Act <br />(`'Environmental Laws"). and shall, at its sole cost and expense, prepare <br />all environmental impact reports required bti~ any local, state, or federal <br />law. <br />c. At least 7 days before SBC commences its work, City shall provide to <br />SBC a copy of all environmental impact reports and soil tests prepared in <br />connection with the Project and shall disclose to SBC all information of <br />which it is aware concerning the existence of any Hazardous Substance <br />within the District. If the information provided reveals the existence of a <br />Hazardous Substance in the area in the District in which SBC will be <br />~~ orking and the City is required by an Environmental Law or otherv<~ise to <br />take some action with respect to the Hazardous Substance such as <br />containnent, cleanup, removal, restoration or other remedial work <br />("Remedial Work"), SBC shall not commence its work until the required <br />Remedial uiork has been completed by City at its sole cost and expense. <br />d. If, after it commences work, SBC discovers the existence of a Hazardous <br />Substance in the area within the District that it is working, SBC shall <br />immediately suspend its vv~ork and notify City of its discovery.
