I. Site <br />a. The site subject to this MOU is the field and play area of the District property <br />located at 1150 Bancroft Avenue, San Leandro, California (APN 077-470-001-3) <br />commonly known as Bancroft Middle School as delineated in Ezhibit A herein <br />called "Site", attached hereto and incorporated herein by this reference. The Site <br />shall be available to the City for public recreation purposes consistent with this <br />MOU, the Community Recreation Act, and all applicable law. <br />b. Site Area <br />The Site contains an area of 208,244 square feet, more or less. <br />II. Use of District Site <br />The use of the Site pursuant to this MOU shall be as follows: <br />a. The District shall have exclusive right to control use of the Site at all times <br />b. For the City's participation and funding, the District will allow the City to use the <br />Site for youth-oriented special events and sports activities without charge if <br />available. When it is available, the District will allow community youth <br />organizations to use the Site. The community will receive benefits by having a <br />track and green space that provides a safe place to play for youth and inspires <br />pride in the community. <br />III. Rules and Regulations <br />District shall establish rules and regulations regarding the conduct of persons using the <br />Site facilities for park and recreation purposes. L. <br />N. Financing and Fees <br />The District and City expect to receive grant funding for the project. Additionally, <br />District shall contribute $100,000.00 towards the cost of the project. The City shall pay <br />the balance required to complete the project up to a maximum of $450,000.00 contingent <br />upon the District receiving the grant award. <br />V.
