MEMORANDUM OF <br />UNDERSTANDING BETWEEN THE <br />CTTY OF SAN LEANDRO AND THE <br />PUBLIC WORKS AGENCY OF THE COUNTY OF ALAMEDA <br />REGARDING THE EMERGENCY MEDICAL SERVICES TAX <br />This Memorandum of Understanding (MOU) is made and entered into as of <br />j')-p,~,~ 30 , 2004 between the City of San Leandro (City), a municipal corporation, and the <br />Public Works Agency of the County of Alameda ("Agency"). <br />RECITALS <br />A. On March 3, 1997 pursuant to Ordinance 97-07 (the "Ordinance"), the City Council <br />established the Emergency Medical Services (EMS) Tax to provide emergency medical services and to <br />maintain an adequate level of paramedic response for emergency medical services within the corporate <br />city limits of the City of San Leandro. <br />B. Said EMS Tax is assessed on all real property within the City and is calculated by <br />formula based on the type of land use, its designated number of "benefit units", and the tax per benefit <br />unit as established in the Ordinance. <br />C. Said tax is calculated and levied by the City using parcel information as provided by the <br />County Assessor. Said tax is collected in conjunction with and at the same time and in the same manner <br />as the County collection of property taxes. <br />D. Agency prepares a similar levy relating to storm water utility charges using the same <br />parcel information and in the same manner as required by the EMS Tax ordinance. <br />E. In order to effect economies of scale and reduce administrative duplication, the City <br />desires to contract with the Agency for the annual levy of the EMS Tax and submission of the parcel <br />information to the County Auditor's Office. <br />NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL AGREEMENTS <br />HEREIN CONTAINED, THE PARTIES HERETO AGREE AS FOLLOWS: <br />SECTION 1. City Performance Obli ations. The City will: <br />(a) Provide Agency with a Fee Table including the most current list of land uses, their <br />"benefit unit" designations and the current benefit unit assessment. This initial EMS Fee <br />Table list is attached hereto as Exhibit A and is incorporated herein by this reference. <br />(b) Provide the Agency with an updated EMS Fee Table no later than July 1 of each year. <br />(c) Review the EMS Fee Table as the Agency has prepared the data and advise Agency of <br />any corrections no later than three (3) working days from availability of the information. <br />(d) Review parcel information provided by Agency and advise Agency of any corrections to <br />the annual levy of the EMS Tax no later than five (5) working days from availability of <br />the newly estimated levy. <br />(e) Submit the proposed EMS Tax levy to the County Auditor's office. <br />(f) Permit the Agency to use the parcel information from the records of the County <br />Assessor for the most recent year available should there arise a circumstance where the <br />Agency is unable to utilize the next year's assessment information. <br />~~ <br />~~yyi <br />f°~ <br />C~ <br />a <br />SECTION .
