9. No comments, and only a single request for information from Caltrans, were received <br />concerning the Negative Declaration during the public review and comment period <br />10. After concluding the public hearing at its meeting of January 9, 2003, the Planning <br />Commission voted to recommend to the City Council approval and adoption of the Negative <br />Declaration and of the proposed Housing Element ,which is attached hereto as Exhibit B, and <br />incorporated by this reference. <br />11. State law requires that the proposed Housing Element must be reviewed by the <br />California Department of Housing and Community Development ("HCD"). Staff has worked <br />closely with HCD, and in October 2002, met with HCD staff to clarify comments received from <br />HCD on the initial review of the proposed Housing Element. The proposed Housing Element <br />was thereafter revised and resubmitted to HCD, which has continued to review it since <br />November. A letter from HCD approving the proposed Housing Element was received on <br />January 9, 2003, in which HCD certifies that the proposed Housing Element is consistent with <br />State law and meets all State requirements for housing elements. Said letter is attached hereto as <br />Exhibit C, and incorporated by this reference. <br />12. On January 21, 2003, the City Council held a public hearing on the proposed Housing <br />Element and Negative Declaration as recommended by the Planning Commission, and has <br />considered a report from staff, the Negative Declaration, written and public testimony from <br />property owners, business owners, outside agencies and other affected parties. <br />follows: <br />NOW, THEREFORE, the City Council of the City of San Leandro does resolve as <br />A. The proposed Housing Element has been prepared in accordance with the State <br />law and the State Department of Housing and Community Development guidelines. <br />B. Adoption of the proposed Housing Element is hereby found to be in the public <br />interest. <br />C. The City Council has considered the Negative Declaration prepared in connection <br />with the proposed Housing Element prior to its adoption <br />D. The City Council does hereby approve the proposed Housing Element, attached to <br />this Resolution as Exhibit A, and adopts it as the Housing Element of the San Leandro General <br />Plan. <br />2 <br />
