AGREEMENT FOR TRANSPORTATION, TREATMENT AND DISPOSAL OF SEWAGE THIS AGREEMENT is made and entered into this 19t~' day of March, 2003, by and between the ORO LOMA SANITARY DISTRICT, Alameda County, California, hereinafter called "DISTRICT," and the CITY OF SAN LEANDRO, hereinafter called "CITY." RECITALS DISTRICT and CITY are party to Agreements dated July 1, 1968, as amended March 13, 1978, and December 1982, which, in part, provides for the transportation, treatment and disposal of sewage emanating from an area of the CITY referred to in said Agreement as the "VALLEY AREA" and "SUBJECT AREA." CITY and DISTRICT find it necessary and appropriate to supersede said Agreements to establish a more equitable formula for payment by CITY to DISTRICT for sewage service provided for therein. SUBJECT AREA is primarily residential in nature and the typical average dry weather sewage flow from SUBJECT AREA is approximately 0.336 million gallons per day. DISTRICT has sufficient hydraulic capacity and treatment capacity to handle the sewage presently emanating from SUBJECT AREA and is therefore willing to provide sewerage service as hereinafter provided. NOW, THEREFORE, IT IS HEREBY AGREED AS FOLLOWS: 1. This Agreement shall supersede and take the place of Agreements between CITY and DISTRICT dated July 1, 1968, as amended March 13, 1978, and December 1982. Said Agreements are hereby terminated as of the time of execution of this Agreement. 2. DISTRICT agrees to transport, treat, and dispose of, in conformity with the requirements of law, the sewage and industrial waste emanating from that area within the City of San Leandro set forth in Exhibit A, attached hereto and incorporated herein by reference, and referred to hereinafter as "SUBJECT AREA", subject to the terms and conditions hereinafter contained.
