AGREEMENT FOR TRANSPORTATION, <br />TREATMENT AND DISPOSAL OF SEWAGE <br />THIS AGREEMENT is made and entered into this 19t~' day of March, 2003, by and between the <br />ORO LOMA SANITARY DISTRICT, Alameda County, California, hereinafter called "DISTRICT," <br />and the CITY OF SAN LEANDRO, hereinafter called "CITY." <br />RECITALS <br />DISTRICT and CITY are party to Agreements dated July 1, 1968, as amended March 13, 1978, <br />and December 1982, which, in part, provides for the transportation, treatment and disposal of sewage <br />emanating from an area of the CITY referred to in said Agreement as the "VALLEY AREA" and <br />"SUBJECT AREA." CITY and DISTRICT find it necessary and appropriate to supersede said <br />Agreements to establish a more equitable formula for payment by CITY to DISTRICT for sewage <br />service provided for therein. <br />SUBJECT AREA is primarily residential in nature and the typical average dry weather sewage <br />flow from SUBJECT AREA is approximately 0.336 million gallons per day. <br />DISTRICT has sufficient hydraulic capacity and treatment capacity to handle the sewage <br />presently emanating from SUBJECT AREA and is therefore willing to provide sewerage service as <br />hereinafter provided. <br />NOW, THEREFORE, IT IS HEREBY AGREED AS FOLLOWS: <br />1. This Agreement shall supersede and take the place of Agreements between CITY and <br />DISTRICT dated July 1, 1968, as amended March 13, 1978, and December 1982. Said Agreements are <br />hereby terminated as of the time of execution of this Agreement. <br />2. DISTRICT agrees to transport, treat, and dispose of, in conformity with the requirements <br />of law, the sewage and industrial waste emanating from that area within the City of San Leandro set <br />forth in Exhibit A, attached hereto and incorporated herein by reference, and referred to hereinafter as <br />"SUBJECT AREA", subject to the terms and conditions hereinafter contained.
