g. After the 10`h year of the Agreement, District shall have no obligation to reimburse <br />the City for any of the City's Improvement Costs. <br />If any of the equipment or facilities can be reused by City at another site, the value of the <br />reused equipment or facilities will be exempt from reimbursement by the District. <br />VII. Ownership of Improvements and Cost Repairing and Replacing Same <br />All improvements installed by City on an Open Space Site shall remain the property of <br />City, and all improvements installed on a Site by District shall remain the property of <br />District. City shall be responsible for the cost of repairing or replacing any of District's <br />property damaged in connection with City's use of said property under this Agreement, <br />normal wear and tear excepted. Each party shall be responsible <br />for the costs of maintaining and repairing, replacing or removing its own property, as <br />necessary to adequately and reasonably maintain the property, facilities, and/or <br />equipment. <br />VIII. Maintenance Responsibilities <br />a. District Responsibilities. Except as set forth below, District shall, at its own cost and <br />expense, maintain the School Area, except the areas defined below as City maintained <br />areas. <br />b. City Responsibilities. City shall, at its own cost and expense, maintain the Open <br />Space Site, all City-installed turf and landscaped areas, including mowing, fertilizing <br />and irrigation. City shall, at its own cost and expense, maintain all City-installed <br />improvements, facilities, and/or equipment on the Site. City shall inspect the <br />restrooms, picnic areas, playground equipment and parking lot annually and make <br />repairs as needed. <br />c. Annual Maintenance Schedule. The City Manager or designee, shall meet with the <br />District Superintendent or designee, in order to determine an annual maintenance <br />schedule which allows City flexible access to school sites but which does not <br />unreasonably interfere with District use. Either party may request, in writing, that the <br />schedule be amended to accommodate circumstances that may arise during the year. <br />Such schedule changes maybe made only by mutual agreement. <br />d. Emergencies and Hazardous Conditions. The City or District shall have the right to <br />initiate action to resolve an emergency and/or hazardous condition on any Site in the <br />most effective and efficient means possible with the least disruption to City or <br />District use. <br />e. Water. City shall sufficiently water all areas of the Site to maintain the current and <br />installed landscaping and vegetation. <br />-4- <br />
