ACTIA 2003-16 <br />3. Accept the percentages used in the allocation of the Measure B sales tax revenues as <br />reflected in 2000 Measure B, the Plan and the PAPCO formula applicable allocation factors as <br />determined by PAPCO and approved by the ACTIA Board. <br />4. Annually develop or update local paratransit plans with local consumer input and <br />governing body approval, including the adoption of appropriate and enforceable performance <br />measures and criteria for services fully or partially funded with 2000 Measure B revenues. <br />Submit plans to PAPCO for review, commentary and recommendation to ACTIA. All plans are <br />subject to review and approval by ACTIA. Use the forms for development of the paratransit <br />plan and budget included in Exhibit B. Submit to ACTIA, at CITY's expense, an independent <br />compliance audit of the funds received and used under this Agreement, including plans and <br />reports of expenditures. The compliance audit is to be completed, certified and provided to <br />ACTIA by December 31 of each year. <br />5. Annually submit paratransit plans using the schedule included in Exhibit C. <br />6. In the event, as of July 1, of each fiscal year, CITY's expenditures of funds received <br />pursuant to this Agreement are less than the amount received by CITY during the previous <br />fiscal year, provide ACTIA with a written explanation as to why the revenues exceeded <br />expenditures and what CITY intends to do with the reserve amount, which may be placed in a <br />reserve fund for use during the term of this agreement. <br />7. Participate as a member of the ACTIA Technical Advisory Committee to address <br />planning, coordination, oversight and reporting requirements, including quarterly and annual <br />reporting. <br />8. Provide signage (i.e., CITY and ACTIA logos; "Your Measure B Sales Tax Dollars <br />at Work") where practical on paratransit vehicles supported by Measure B funds so that <br />Alameda County taxpayers are informed as to how the Measure B funds are being used. <br />Include a~description of such signage in the annual report submitted to ACTIA. <br />9. Actively participate in a Public Awareness Program, in partnership with ACTIA, the <br />Citizens Advisory Committee, the Citizens Watchdog Committee and/or PAPCO, as a means of <br />informing CITY's constituents of the benefits being derived from the use of 2000 Measure B <br />funds. <br />10. Provide updated and accurate information on CITY's website, in order to inform the <br />public on how the Measure B funds for paratransit are being used in the CITY. <br />11. Provide quarterly updates to ACTIA on the progress of the implementation of the <br />CITY's paratransit program, including but not limited to CITY's compliance with applicable <br />performance measures and criteria. <br />12. By December 31 of each year, provide a report of all expenditures of Measure B <br />funds received pursuant to this Agreement in the previous fiscal year, using the template <br />provided by ACTIA and made available on the ACTIA website. The report shall show the <br />amount spent in that reporting year, the total expenditures to date, a brief description of the <br />expenditures, and the benefits realized from said expenditures. <br />3 <br />011455.0001\610617.3 <br />
