>~ <br />IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2003-203 (1878) <br />RESOLUTION AFFIRMING THE CITY OF SAN LEANDRO'S COMMITMENT TO <br />PREVAILING WAGE LABOR PRACTICES <br />WHEREAS, the City Council of Long Beach is opposing proposed legislation that would <br />require charter cities to pay prevailing wage; and <br />WHEREAS, the California Legislature has declared that the prevailing wage law is a matter <br />of Statewide concern; and <br />WHEREAS, the California Court of Appeal recently ruled in the Department of Industrial <br />Relations, et. al. vs. the City of Long Beach that the prevailing wage law addresses Statewide <br />concerns and therefore applies to construction projects subsidized by chartered cities, just as it does <br />to projects subsidized by State and local public agencies and political subdivisions; and <br />WHEREAS, the City of San Leandro, a charter city, has long supported prevailing wage for <br />the community; and <br />WHEREAS, the City Council adopted a modification to the Municipal Code through. <br />Ordinance No. 85-039, adopted October 25, 1985, that formalized the City Council's support of <br />prevailing wage. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br />follows: <br />The City of San Leandro endorses the California Legislature's conclusion that the prevailing <br />wage law addresses Statewide concerns and will not participate in efforts to overturn or depublish <br />the City of Long Beach decision; and <br />The City Council of the City of San Leandro reaffirms its support for prevailing wage <br />policies; and <br />
