recreation purposes pursuant to said Community Recreation Act, as the provisions thereof exist,
<br />or hereafter may be amended; and
<br />NOW, THEREFORE, in consideration of the covenants and conditions hereinafter set
<br />forth, and pursuant to the provisions of the Education Code hereinabove referred to, it is agreed
<br />as follows:
<br />I. Site
<br />a. The site subject to this Agreement is one (1) school site and one (1) open space site of
<br />the District located within the limits of City ("Site"), commonly known as Farrelly
<br />Complex as indicated in Exhibit A, attached hereto and incorporated herein by this
<br />reference. The Site shall be available to the City for public recreation purposes
<br />consistent with this Agreement, the Community Recreation Act, and all applicable
<br />law.
<br />b. Physical Description of Land
<br />Commencing at the point of intersection of the northern line of Dutton Avenue with
<br />the eastern boundary line of Lot 52, as said avenue and lot are shown on that certain
<br />Map entitled, Map of Dutton Manor Addition, filed July 29, 1912, Map Book 27,
<br />page 7, Alameda County Record; thence north 87° 45' east, along said line of Dutton
<br />Avenue, 358.05 feet; thence north 07° 30' east, 98.23 feet to the TRUE POINT OF
<br />BEGINNING; thence continuing north 07° 30' east 151.31 feet; thence south 88° 53'
<br />west, 142.12 feet; thence south O1 ° 07' east, 92.00 feet; thence north 88° 53' east,
<br />11.70 feet; thence south O1° OT east; 57.60 feet; thence north 88° 53' east, 107.75
<br />feet to the TRUE POINT OF BEGINNING.
<br />The above described parcel of land contains an area of 18891 square feet more or
<br />less. As more particularly described on that diagram designated Exhibit A, attached
<br />hereto and by this reference incorporated herein.
<br />c. The site is currently used by the City for recreational activities and is not used by the
<br />District.
<br />d. The current maintenance responsibilities for the City include repair and installation of
<br />toilets/urinals, repair and installation of showers, sinks, and fixtures, repair of hot
<br />water mixing valves, repair/replacement of pool boiler, repair/replacement of hot
<br />water heaters, maintenance of sewer drains/blockages, repair/replacement of
<br />lamps/fixtures, repair/replacement of receptacles, repair/replacement of pool pumps
<br />and associated wiring, repair/replacement of power distribution systems and
<br />associated wiring, repair oI counter tops, mirrors, repair/replacement of shower
<br />surround walls, clean, sanitize, and stock restrooms, monitor and adjust water
<br />chemistry, brush and vacuum pool, control algae, backwash and clean filters,
