responses are contained in a separately bound document, the Final EIR ("FEIR"), dated <br />February, 2002. The comments and responses were distributed to or otherwise made available to <br />the Planning Commission, City Council, responsible agencies, and other interested parties. <br />Draft responses were mailed to public agency commentors at least 10 days prior to certification <br />of the EIR. <br />14. On April 1, 2002, the City Council held a duly noticed public hearing to receive <br />comments on the Draft General Plan and FEIR, and to consider the Planning Commission's <br />recommendation on such documents. Public comment was received on the Draft General Plan <br />and DEIR at the public hearings. A staff report, dated April 1, 2002, was prepared, containing <br />analysis and recommendations on the documents. <br />15. On April 1, 2002, the City Council held a duly noticed hearing to consider <br />certification of the San Leandro General Plan Final Environmental Impact Report. <br />16. Staff reviewed the revisions to the General Plan Update and related EIR as considered <br />by the City Council during its hearings and determined that the revisions have not resulted in the <br />addition of new "significant information" to the EIR and thus, that new notice and recirculation <br />of the EIR for additional comment and consultation is not required pursuant to Public Resources <br />Code Section 21092.1. <br />17. The Environmental Impact Report for the General Plan Update consists of the <br />following documents which are incorporated herein by reference: <br />a) Draft Environmental Impact Report, dated November, 2001 <br />b) Final Environmental Impact Report, dated February, 2002 <br />NOW, THEREFORE, the City Council of the City of San Leandro does resolve as <br />follows: <br />1. The City Council of the City of San Leandro certifies that the final EIR for the <br />General Plan Update has been completed in compliance with the procedural and substantive <br />requirements of CEQA and the CEQA Guidelines, and is adequate for review and consideration <br />of the General Plan Update project, including proposed revisions to the Draft General Plan as <br />considered by the City Council. <br />2. The City Council of the City of San Leandro finds that the final EIR for the General <br />Plan Update was presented to the City Council for review and consideration, that the final EIR <br />reflects the independent judgment of the City of San Leandro, and that the City Council reviewed <br />and considered the information contained in the Final EIR prior to taking action on the General <br />Plan Update. <br />
