a. The buildings, facilities, structures, or other improvements are of benefit <br />to the project area or the immediate neighborhood in which the project is located; and <br />b. That no other reasonable means of financing the buildings, facilities, <br />structures, or other improvements are available to the community; and <br />c. That the payment of funds for the cost of buildings, facilities, structures, <br />or other improvements will assist in the elimination of one or more blighting conditions <br />inside the project area; and <br />d. The project is consistent with the Five Year Implementation Plan adopted <br />by the Agency pursuant to Section 33490. <br />WHEREAS, the San Leandro City Council has adopted the foregoing findings <br />for the proposed Public Improvements; <br />WHEREAS, as more particularly described in the staff report accompanying this <br />Resolution (the "Staff Report"), the installation and construction of the Public <br />Improvements will be of benefit to the Project Areas, will eliminate blighting conditions <br />in the Project Areas, and will be consistent with the Implementation Plan in that the <br />Public Improvements will upgrade the appearance of the Project Areas, provide necessary <br />interim parking for business and services located in the Project Areas, and facilitate the <br />expansion, seismic upgrade and retrofitting of the Estudillo/Callan parking garage that <br />will provide increased parking for patrons of and visitors to the Project Areas in an ADA- <br />accessible facility; <br />WHEREAS, Agency and City staff are aware of no other source of funds <br />reasonably available to undertake the installation and construction of the Public <br />Improvements, as tax revenue that might otherwise be available for such purposes is <br />committed for other public projects and the provision of essential services such as police <br />and fire services; <br />WHEREAS, as more fully described in the Staff Report, the City has no <br />unrestricted general fund revenue available to undertake the construction and installation <br />of the Public Improvements without a reduction in vital community services, and the City <br />Council has made a finding that it does not have and cannot reasonably obtain revenue <br />for such purposes, and therefore no other reasonable means of fmancing the Project <br />exists; and <br />WHEREAS, Agency and City staff have prepared a Cooperation Agreement (the <br />"Cooperation Agreement") which provides for City and Agency cooperation in the <br />fmancing and completion of the Public Improvements. <br />NOW THEREFORE, BE IT HEREBY RESOLVED by the Redevelopment <br />Agency of the City of San Leandro as follows: <br />RESOLUTION N0.2009-021 RDA 2 <br />
