Hollister <br />City Manager <br />Debbie Pollan, Facilities & Open Space Manager <br />SUBJECT PROJECT/PROJECT DESCRIPTION: <br />AN ORDINANCE AMENDING TITLE 4, CHAPTER 4-19, OF THE SAN LEANDRO <br />MUNICIPAL CODE, ADDING NEW SECTIONS 4-19-135, 4-19-140, 4-19-145, AND 4-19- <br />150 RELATING TO RULES AND REGULATIONS FOR USE OF THE WES MCCLURE <br />BOAT LAUNCH RAMP AT SAN LEANDRO MARINA <br />SUMMARY AND RECOMMENDATION <br />Staff recommends that the City Council approve an ordinance to amend Title 4, Chapter 4-19 of <br />the Municipal Code to establish citation authority for vehicles in violation of the recently <br />approved boat launch fee. <br />BACKGROUND <br />In June of 2009, the City Council approved a new boat launch fee for the Wes McClure Boat <br />Launch. This fee is not a parking fee, meaning that vehicles without trailers may continue to park <br />in the lot free of charge. The fee is specifically for launching of trailered boats. <br />DISCUSSION <br />Starting July 7, 2009, staff installed signage and an un-manned pay kiosk and has been selling <br />both daily and yearly launch permits at the Harbor Master's Office. As of September 15, the City <br />had received $1,700 from the purchase of 17 yearly permits plus $2550 from 255 daily permits. <br />This total of $4,250 in launch fees exceeds the materials and associated start-up costs of $2,516. <br />As this is an entirely new fee and not a parking fee (which is covered under Municipal Code <br />Chapter 6-1), the Code does not currently provide citation authority for staff, nor is there an <br />established violation fine. Currently, courtesy letters are left on vehicles that are found to not <br />have obtained a launch permit, but there is no fine if people do not pay. The proposed new <br />language establishes the citation authority. A public hearing will be scheduled for October 5 to <br />consider an amendment to the Fee Schedule to establish a fine amount of $36. <br />Current City Council Policy <br />N/A <br />
