MCI Encroachment Agreement 2 October 5, 2009 <br />still have capacity remaining, so the addition of MCI facilities within the City's right of way will <br />not use a significant portion of the remaining right of way capacity. <br />An existing conduit under the roadway on Bancroft Avenue that was ariginally installed by MFS <br />Network Technologies has been acquired by MCI for use as a telecommunications line. MCI <br />plans to connect several cell phone sites to this existing conduit so that data may be transferred <br />between the sites via fiber optic cable. <br />MCI is not a primary service provider; people who have local phone service with AT&T may <br />elect to use MCI to provide some specific features, such as long distance. The City will not <br />directly collect either a franchise fee or a utility tax from MCI but subscribers to its service will <br />pay a utility tax on their primary service. <br />This agreement allows MCI to install its facilities within any public right of way throughout the <br />city. No work shall be done without an encroachment permit nor shall any work have a negative <br />impact on the roadway or other existing utilities. MCI is required to relocate or remove any <br />facility that is in conflict with City construction projects. All costs of permitting and inspection <br />will be borne by MCI.
