Grantor owns that certain real property situated in the City of San Leandro, <br />California, at 2599 Fairway Drive, APN 079A-0590-001-OS (the "Property"). <br />B. Grantee desires to obtain a private utility easement to retain their existing facilities on <br />a portion of the Property under the terms and conditions hereinafter set forth. <br />C. Grantee also desires a second non-exclusive easement for the maintenance and repair <br />of the existing facilities on a portion of the Property under the terms and conditions hereinafter <br />set forth. <br />NOW, THEREFORE, the parties agree as follows: <br />1. Grant of Easements Grantor hereby grants to Grantee a private utility easement on a <br />portion of the Property, as more particularly described in Exhibits Al and B 1 attached hereto and <br />incorporated herein by reference (the "Private Utility Easement Area"). In addition, the Grantor <br />hereby grants to Grantee an access easement (the "Access Easement Area"), as more particularly <br />described in Exhibits A2 and B2. <br />In consideration for such Grant of Easement, Grantee agrees to comply with all of the <br />terms and conditions set forth herein. The use of the Private Utility Easement Area and Access <br />Easement Area granted herein shall be limited to the maintenance, repair, and replacement of the <br />existing cable service equipment and appurtenances thereto, as more particularly described as <br />follows: <br />
